What has not Changed:

• The obligation of individuals with disabilities to demonstrate with appropriate and objective documentation that they are qualified individuals with disabilities.

• The requirement that the need for each and every academic adjustment auxiliary aid and/or service requested as an accommodation be adequately supported.

• The right to challenge the opinions and/or conclusions of individual’s professionals and/or experts

• The right of institutions to refuse to provide accommodations that would fundamentally alter programs or services or impose an undue administrative or financial burden

• As between equally “effective” accommodations, the right of institutions to choose what accommodation it will provide.

• Legitimate and reasonable decisions of institutions are entitled to deference.
